Destry Hunt, Ramona Goolsby, and Erin Clements have filed a complaint alleging violations of the Inspection of Public Records Act (IPRA) against the Office of the New Mexico Secretary of State and Secretary of State Maggie Toulouse Oliver, named in her official capacity. The suit was filed in the First Judicial District Court, Case No. D-101-CV-2026-01665.
According to the complaint, each plaintiff submitted an IPRA request to the Secretary of State’s Office for emails sent or received by a Secretary of State employee, Kari Fresquez, covering November 2022. The complaint alleges that the office produced other records and represented that no responsive records had been withheld but did not produce November 2022 canvass correspondence between Fresquez and county clerks’ offices that eight New Mexico counties separately produced in response to parallel requests.
The complaint alleges that, in that correspondence, Fresquez identified precinct-level vote discrepancies for the county clerks, directed corrections to vote tallies in the Secretary of State’s State Elections Registration and Voting Integrity System (SERVIS) database, and locked and unlocked county access to the system as corrections were made.
The complaint seeks a court order compelling production of the withheld records, together with statutory damages of up to $100 per day per plaintiff, costs, and reasonable attorney fees, as provided under IPRA.
